These Terms and Conditions of Sale (the "Agreement") are the exclusive terms and conditions related to any order placed with or accepted by www.MobileFlyers.info and/or www.MobileFlyers.mobi (both hereninafter referredt to as "The "Company".) THE PLACEMENT OR SUBMISSION OF ANY FLYER ORDER TO THE COMPANY INDICATES BUYER'S COMPLETE AND UNCONDITIONAL CONSENT TO, AND ACCEPTANCE OF, THESE TERMS AND CONDITIONS. The publication of, and Buyer's acceptance of publication of any Flyer is expressly conditioned on acceptance of all the terms and conditions of this Agreement.
1. PRICES
Published prices, unless otherwise specified, are subject to change without notice.
2. PAYMENT
Unless otherwise provided in writing, full payment is due when Flyer is submitted for publication.
3. TAXES
Seller shall pay all taxes levied or based on any amounts payable under this Agreement, including without limitation, state and local sales and use taxes.
4. TIME OF POSTING
All Flyers submitted for publication, and paid for in full, shall be published to the web sites immediately, and for the duration of the time period that was selected in the publication order.
5. CHANGES AND ALTERATIONS
Realtor®s may at any time make any such changes in content, description, or photographs at any time without charge. Such changes shall be subject to this Terms and Conditions of Sale, and Conditions of Use agreements.
6. PAYMENT METHODS WE ACCEPT
The Company accepts American Express®, Visa®, MasterCard®, and/or PayPal® for payment.
7. CONTENT
The Company shall have no liability or responsibility for errors or ommisions published to the sites by the Realtor®, its agent(s), or any other party or parties submitting Flyer(s) to the sites.
8. LIMITATIONS ON WARRANTIES

9. LIABILITIES AND CONSEQUENTIAL DAMAGES
IN NO EVENT SHALL REALTOR® OR THEIR CLIENT BE ENTITLED TO ANY CONSEQUENTIAL, INCIDENTAL OR CONTINGENT DAMAGES OF ANY KIND, WHETHER ARISING OUT OF BREACH OF CONTRACT, WARRANTY (INCLUDING NEGLIGENCE AND STRICT LIABILITY) OR OTHER THEORIES OF LAW, WITH RESPECT TO SERVICES RENDERED BY THE COMPANY, OR ANY UNDERTAKINGS, ACTS OR OMISSIONS RELATING THERETO.
10. LIMITATIONS ON SUITS AND ACTIONS

11. APPLICABLE LAWS
All laws and regulations required to be incorporated in agreements of this character are incorporated herein by this reference. These terms and conditions shall be governed by and construed according to the laws of the state of Texas, excluding any choice of law rules.
12. FINAL AGREEMENT
Except as otherwise agreed in writing, these terms and conditions constitute the entire agreement between the Company and Realtor®, Realtor®'s agent(s), or Realtor®'s client(s).
